5.11 | Workplace Safety
5.11.1 | Drug-Free Workplace

SU is committed to provide a safe and productive working environment. Alcohol and drug abuse pose a threat to the health and safety of employees and to the security of our equipment and facilities. For these reasons, SU is committed to the elimination of drug and/or alcohol use and abuse in the workplace.

The unlawful manufacture, distribution, dispensation, possession, or use of a controlled substance is prohibited in any space operated by SU. Observance of this policy is a condition of employment and violation of such will subject the employee to appropriate disciplinary action which may include termination.

Individuals who violate the Drug-Free Workplace policy may also be subject to penalties, including arrest, under Indonesian law.

5.11.2 | Workplace Bullying and/or Harrasment

SU defines bullying and harassment as inappropriate behavior, either direct or indirect, whether verbal, physical or otherwise, conducted by one or more persons against another or others, at the place of work and/or in the course of employment.

Workplace bullying and/or harassment will not be tolerated, and those employees found to have committed these actions in the workplace are subject to disciplinary action up to and including termination or dismissal from employment. This applies to all employees.

Bullying and/or harassment may be intentional or unintentional. However, it must be noted that where an allegation of bullying and/or harassment is made, the intention of the perpetrator(s) is irrelevant and will not be given consideration when determining discipline. It is the effect of the behavior upon the individual that is important.

The following types of behavior are examples of bullying and/or harassment:

  1. Verbal Bullying
Slandering, ridiculing or maligning a person or his/her family; persistent name calling that is hurtful, insulting or humiliating; using the person as a subject of jokes; abusive and offensive remarks. This includes repeated, harmful comments made to or about a person by one or more other people.
  2. Physical Bullying
Pushing, shoving, kicking, poking, tripping, assault or threat of physical assault; damage to a person’s work area or property. This includes any repeated, physically aggressive actions toward a recipient.
  3. Cyber Bullying
Using digital means, such as the internet, cell phones or other devices to bully someone.
  4. Sexual Harassment
Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when either:
  • The conduct is made as a term of condition of an individual’s employment, education, living environment or participation in the University community.
  • The acceptance or refusal of such conduct is used as the basis or a factor in decisions affecting an individual’s employment, education, living environment, or participation in the University community.
  • The conduct unreasonably impacts an individual’s employment or academic performance or creates an intimidating, hostile or offensive environment for that individual’s employment, education, living environment, or participation in the University community.
